For the purpose of these Terms & Conditions, the following terms shall have the meanings assigned to them:

To use the Platform, you must meet the following eligibility requirements:

• You must be at least 18 years of age at the time of registration.
• You must have the legal capacity to enter into a binding contract under applicable Indian law.
• You must provide accurate, current, and complete information during registration.
• You must not be barred or suspended from using the Platform by any prior decision of the Company.
• Service Providers must possess valid driving licenses, vehicle registration, and all required permits under Indian Motor Vehicles Act.

Registration on the Apna Bhadagadi Platform requires the following:

• A valid Indian mobile number for OTP (One-Time Password) verification.
• Accurate personal details including name, city, and vehicle details (for Service Providers).
• Acceptance of these Terms & Conditions and the Privacy Policy.

You are solely responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorised use of your account.

Apna Bhadagadi provides the following services through its Platform:

• Trip Posting: Service Providers can post vehicle availability and trip details across multiple cities.
• Trip Search: Customers can search available trips by city, vehicle type, and date.
• Driver–Customer Connection: The Platform facilitates communication between Service Providers and Customers.
• Multi-City Vehicle Service: Users can operate across multiple cities registered in their profile.
• Business Profile: Service Providers can build a business profile visible to potential customers.

All Users agree to the following responsibilities while using the Platform:

• Use the Platform only for its intended lawful purpose.
• Not post fake, duplicate, or misleading trip listings.
• Not engage in any form of harassment, abuse, or threatening behaviour.
• Not attempt to hack, scrape, reverse-engineer, or disrupt the Platform.
• Maintain professional and respectful communication with other Users.
• Not use the Platform to promote illegal activities, including unlicensed transport operations.
• Comply with all applicable laws and regulations, including traffic and transport laws.

The following payment terms apply to all transactions facilitated through the Platform:

• The Platform currently acts as a listing and connection service only. Direct payments may be handled between Users independently.
• Any fare, pricing, or payment terms are agreed upon directly between the Customer and Service Provider.
• The Platform does not process, hold, or guarantee payments between Users.
• Premium subscription or feature fees charged by the Platform are non-refundable unless specified otherwise.

• Cancellation policies are determined solely by the Service Provider and agreed upon at the time of booking.
• The Platform does not mandate or enforce any specific cancellation or refund policy between Users.
• Any refund disputes are to be resolved directly between the Customer and Service Provider.
• The Company is not responsible for any loss, cost, or inconvenience caused by cancellation or failure to provide services.

To the maximum extent permitted by applicable law, Apna Bhadagadi shall NOT be liable for:

• Any delays, rescheduling, or cancellations of trips.
• Any accidents, injuries, or damage occurring during a trip.
• Any miscommunication between Users.
• The quality, safety, or legality of services provided by Service Providers.
• Any loss of data, revenue, or business opportunity arising from use of the Platform.
• Temporary or permanent unavailability of the Platform due to technical issues.

The Company reserves the right to suspend, restrict, or permanently terminate any User account without prior notice in the following cases:

• Fraudulent or deceptive activity on the Platform.
• Misuse or abuse of Platform features.
• Violation of these Terms & Conditions.
• Posting false, harmful, or illegal content.
• Engaging in harassment or threatening behaviour.
• Any activity that violates applicable Indian laws.

Upon suspension, the User's access to the Platform and all associated data may be immediately revoked. Users may appeal a suspension by contacting our support team.

Your privacy is important to us. The collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

• User data is collected only for the purpose of providing and improving Platform services.
• We implement industry-standard security measures to protect user data.
• We do not sell user data to third parties for commercial purposes.
• Users may request deletion of their account and associated data at any time.

• The Platform may contain links to or integrate with third-party services, websites, or applications.
• These third-party services are governed by their own terms and privacy policies.
• The Company is not responsible for the content, accuracy, or practices of any third-party services.
• Use of third-party services through the Platform is at the User's own risk.

Apna Bhadagadi reserves the right to modify, update, or replace these Terms & Conditions at any time without prior notice.

• Updated terms will be posted on the Platform with a revised "Last Updated" date.
• Significant changes may be communicated via SMS or in-app notification.
• Continued use of the Platform after any modification constitutes acceptance of the revised Terms.

• These Terms shall be governed by and construed in accordance with the laws of India.
• Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of courts in Gujarat, India.
• Both parties agree to attempt resolution through good-faith negotiation before initiating legal proceedings.
• The Platform complies with applicable Indian laws including the Information Technology Act, 2000 and Consumer Protection Act, 2019.
